Nunc pro tunc (Better late than never)

Nunc_pro_tunc is a Latin expression in common legal use in the English language. It means Now for then. This phrase is used to express that a thing is done at one time which ought to have been performed at another. In immigration context it means the petition/application approval indicating a date starting from prior to the filed date.

Please note Nunc Pro tunc is purely discretionary a humble officer can definitely condone the delay in filing the petition. This normally occurs in an H-4 dependent case where the beneficiary or the principal applicant would have forgotten to change the status or extend the dependent status along with their petitions. It is always advisable to go out of US and get an H-4 Visa stamped if the delay in requesting H4 status is longer, if not, Nunc pro tunc comes to rescue. Request the officer by explaining your situation and indicate that you have always maintained your status earlier except in the present scenario which was an unintentional mistake, don’t forget to add your sworn statement .
